IMPORTANT NOTICE: PLEASE BE AWARE THAT SECTION 30 CONTAINS PROVISIONS GOVERNING HOW TO RESOLVE DISPUTES BETWEEN YOU AND FANDUEL SPORTSBOOK. AMONG OTHER THINGS, SECTION 30 INCLUDES AN AGREEMENT TO ARBITRATE, WHICH REQUIRES, WITH LIMITED EXCEPTIONS, THAT ALL DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING AND FINAL ARBITRATION. SECTION 30 ALSO CONTAINS A CLASS ACTION AND JURY TRIAL WAIVER. PLEASE READ SECTION 30 CAREFULLY.
PLEASE READ THIS SECTION 30 CAREFULLY (the “Arbitration Agreement”) – AS IT SIGNIFICANTLY AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT. YOU HAVE THE RIGHT TO OPT OUT OF THIS ARBITRATION AGREEMENT AS PROVIDED IN SECTION 30.7 BELOW.
To promote efficiency and cost savings for the parties and to encourage informal resolution of disputes, NAM shall first administer a single batch of 100 randomly-selected Demands, which shall be adjudicated by a single arbitrator. The results of the first completed batch of Demands shall be provided to a mediator jointly selected by the parties (or, if the parties are unable to agree on a mediator, to a mediator selected from a group of 5 mediators proposed by NAM, with FanDuel Sportsbook, on the one hand, and Claimants’ Counsel, on the other hand, being able to strike one mediator each and then rank the remaining mediators and the highest collectively ranked mediator being selected. After the results of the first batch are provided to the mediator, then FanDuel Sportsbook, Claimants Counsel, and the mediator will have 90 days (the “Global Mediation Period”) to attempt in good faith to resolve the outstanding Demands. If, following the Global Mediation Period, 25 or more Demands subject to the Batch Arbitration have not been resolved, NAM shall administer all remaining batches concurrently, to the extent possible, until all Demands are resolved.
All parties agree that Demands are of a "substantially similar nature" if they arise out of or relate to the same event or factual scenario and raise the same or similar legal issue(s) and seek the same or similar relief. To the extent the parties disagree on the application of the Batch Arbitration process, the disagreeing party shall advise NAM, and NAM shall appoint a sole standing Procedural Arbitrator or Emergency Arbitrator (the “Administrative Arbitrator”) to determine the applicability of the Batch Arbitration process. To expedite resolution of any such dispute, the parties agree the Administrative Arbitrator may set forth such procedures as are necessary to resolve any disputes promptly. The Administrative Arbitrator’s fees shall be paid by FanDuel Sportsbook.
You and FanDuel Sportsbook agree to cooperate in good faith with NAM to implement the Batch Arbitration process including the payment of single administrative fees for batches of Demands, as well as any steps to minimize the time and costs of arbitration, which may include: (1) the appointment of a discovery special master to assist the arbitrator in the resolution of discovery disputes; and (2) the adoption of an expedited calendar of the arbitration proceedings. This Batch Arbitration provision shall in no way be interpreted as authorizing a class, collective and/or representative arbitration or action of any kind, except as expressly set forth in this provision, and nothing about the Batch Arbitration process will preclude any party from participating in any arbitration administered according to that process
If, after all reasonable methods to resolve the dispute with us have been exhausted, your dispute is still unresolved and it arises out of your use of the Services while physically located in New York, you can contact the New York State Gaming Commission at:

Customers are responsible for managing their in-play wagers at all times.
Customers should be aware that “live” broadcasts, streams, or data feeds may be delayed, interrupted, or inaccurate. The extent of such delay may vary depending on the source and method of transmission.
FanDuel Sportsbook does not guarantee the accuracy or timeliness of live scores, time remaining, or event status information and accepts no liability for any inaccuracies.
If a bet is accepted on a market where the outcome has already been determined at the time of acceptance, such bet will be void, regardless of whether it is subsequently determined to be a winning or losing bet.
Unless otherwise specified within specific sports rules, all markets will be settled based on the official result declared by the relevant governing body at the time of settlement, regardless of any subsequent disqualification or amendment to results.
If no official result is available, the result will be determined by FanDuel Sportsbook (acting reasonably) using reliable independent sources. In such cases, if any new information becomes publicly available within 48 hours of settlement, then FanDuel Sportsbook shall (acting reasonably) determine either:
whether the market should be reinstated or resettled in light of this new information; or
whether or not to wait for further information before deciding whether to reinstate or resettle the market. Except where FanDuel Sportsbook has announced that it is waiting for further information, any information that comes into the public domain more than 48 hours after a market has been settled shall not be considered by FanDuel Sportsbook (regardless of whether or not such information may have led to a different result).
Except where FanDuel Sportsbook has notified that it is awaiting further information, any information that becomes available more than 48 hours after settlement will not result in a settlement change.
In the event of any uncertainty about any result or potential result, FanDuel Sportsbook reserves the right to suspend settlement until the uncertainty is reasonably resolved. FanDuel Sportsbook reserves the right to void any market if the uncertainty cannot be resolved.
FanDuel Sportsbook may amend or reverse the settlement of a market where:
the official result differs from the result used for initial settlement; or
a market has been settled incorrectly due to human, technical, or system error.
Resettlement may result in adjustments to a customer’s account balance, including the deduction of previously credited winnings.
Resettlement will occur within a reasonable period following settlement.
In the event of a withdrawal of a selection after the start of an event due to such selection testing positive for a virus or other disease, all wagers on that selection shall be void.
All-In Betting - bets are settled whether or not a participant starts or completes the event and no refunds will apply. Markets using All-In rules will be clearly indicated on the FanDuel Sportsbook Betting Apps.
In the event a player, team or selection wins an Outright market (e.g., NCAA Men’s Basketball Championship) but were not offered for betting due to state regulations forbidding betting on that player, team or selection then all bets placed on that market will be void. This does not include cashed out bets, which will be settled at the specified cash out offer received by the customer. For markets with multiple winners (e.g., To Make Final Four), if a non-listed player, team or selection wins, then all bets are action.
Weekly/Daily specials: All relevant games must be played to a natural completion for wagers to stand. In the event one or more game(s) are postponed and/or have a venue change, all wagers in the relevant market will be refunded.
Regarding player markets. All listed players must participate for wagers to stand. If one or more player(s) listed do not play, all wagers will be refunded.
Certain markets will be offered on an “all-in” basis. This means that, if a player, team or other competitor is withdrawn from an event before the competitor has taken part in the event, then any bet placed on that player, team or competitor (as applicable) will be deemed a losing bet.
If events occur beyond the reasonable control of FanDuel Sportsbook that materially affect an event, competition, or market, FanDuel Sportsbook reserves the right to void, cancel, restrict, or adjust any affected wagers.
Such events may include, but are not limited to:

Settle wagers based on available information;
Adjust payouts to reflect the altered conditions;
Suspend or delay settlement; or
Void affected wagers where a fair settlement cannot be determined.
FanDuel Sportsbook reserves the right to take such actions either before or after an event has started, and prior to or following settlement where necessary, to ensure fair and consistent outcomes.
This section applies to all markets relating to the outcome of a competition, season, or tournament (“futures markets”) unless otherwise specified
Where a competition or event is completed or officially concluded, all Futures Markets will be settled based on the official result declared by the relevant governing body.
If a competition or season is shortened, suspended, or otherwise materially altered:
Futures Markets will be settled in accordance with the official ruling of the relevant governing body, provided such ruling is made within 90 days of the originally scheduled completion date;
If no official ruling is made within 90 days, all affected Futures Markets will be void, unless the outcome has already been determined.
Bets will be settled where the outcome is certain and cannot change, regardless of whether the competition is completed. This includes, but is not limited to:
Outcomes that have been mathematically determined; or
Outcomes where no remaining events could alter the result.
If a material change to the format or structure of a competition occurs after bets are placed, and such changes removes or materially alter the possibility of an outcome, affected bets will be void unless the outcome had already been determined prior to the change.
If a competition or event is postponed and rescheduled bets will remain valid, customers may request to void bet prior to the start of the rescheduled event.
If the competition is not rescheduled with 90 days of the original competition date, all bets will be void.
Unless otherwise specified, if an event does not start or is cancelled, all bets on that event will be void.
If the event does not reach a natural conclusion within 48 hours after the scheduled completion date, then all bets on markets for this event will be void, except for bets on any markets that have been unconditionally determined and cannot change
Where the outcome of a market has been determined prior to an event being abandoned, suspended, or otherwise not completed, such bets will be settled accordingly.
If an event is officially declared a forfeit, all bets on that event will be void, unless otherwise specified.
If an event is declared a no contest or similar, bets will be void unless the outcome had already been determined prior to such declaration.
For events that form part of a tournament or competition:
Markets will be settled in accordance with the official ruling of the relevant governing body, provided such ruling is made within 90 days of the originally scheduled completion date;
If no official ruling is made within 90 days, all affected bets will be void, unless the outcome has already been determined.
If no further sporting action takes place in relation to a market and no official result is declared, all bets on that market will be void.
Unless otherwise specified, bets will stand if the venue of an event is changed after a wager has been placed.
Bets will be void if the venue is changed to the home venue of the originally designated away team, or for international events, the venue is changed to a different country.
Bets will not be voided solely due to a change in playing surface, or a change between indoor and outdoor conditions.
If a market has no specific rule listed in Specific Sports Rules, then the following will apply.
If the scheduled duration of an event is changed after a bet is placed but before the start of the event, bets on the event will be void, unless otherwise specified.
Some markets refer to the length of time until an occurrence in the event (e.g., time of first goal). If an event happens in stoppage or injury time after any regular time period then it will be deemed to have occurred at the end of the regular time period. For example, if a goal is scored in first half stoppage-time in a soccer match it will be deemed to have occurred at the 45th minute.
Unless otherwise specified, all bets apply to full duration of regular time, including stoppage or injury time.
Extra time, overtime, or penalty shootouts are not included for settlement purposes unless explicitly stated.
Any reference to a number of days in these Rules shall mean the end of the final day in the local time zone of the event.
Any “to qualify” market will be determined by the competitor or team that progresses, regardless of whether they subsequently participate in the next round.
Markets will be settled after the qualifying stage and any subsequent amendment to the competition will not change the settlement of the market.
Dead heat rules apply where there are more winning selections in a market than expected based on the number of available winning positions.
In the event of a dead heat, returns will be calculated using the following formula:
Returns = (Stake x (Number of Expected Winners/Number of Actual Winners)) * Odds
Where two or more selections tie as winner the stake will be divided equally between the number of tied selections and the reduced stake will be settled at the full odds, the remaining portion of the stake will be settled as a losing bet.
For markets involving multiple finishing positions (e.g., Top 10) the number of available positions will be divided among the tied selections, the stake will be reduced proportionally based on the numbers of positions available relative to the number of tied selections, and the reduced stake will be settled at the full odds.
Where a selection within a parlay is subject to a dead heat the stake applied will be reduced in accordance with the rules set out in this section.
FanDuel Sportsbook makes every effort to ensure that all markets and odds are accurate. However, errors may occur.
FanDuel Sportsbook reserves the right to void, cancel, or correct any bet or market where an error has occurred.
Errors include, but are not limited to:
odds, prices, or lines that are materially different from those generally available in the market at the time the bet was placed;
odds or prices that are clearly incorrect given the likelihood of the outcome at the time the bet was placed;
bets accepted after an event has started where the market was not intended to be in-play;
bets accepted after the outcome of an event or occurrence is known or reasonably knowable;
incorrect event, participant, or market information; or
any technical, system, or human error affecting the acceptance, pricing, or settlement of a bet.
Where an error has occurred, FanDuel may, acting reasonably, void the affected bet or market, or settle the bet at the correct price or terms, as determined at the time of acceptance.
Any bet accepted on a market where the outcome has already been determined at the time of acceptance will be void, regardless of whether it is subsequently determined to be a winning or losing bet.
In the event that a match is displayed in error on the FanDuel Sportsbook site that cannot occur as it is listed because:
One or more participants listed is incorrect therefore invalidating the matchup, OR:
A match between two participants is listed under the incorrect competition
FanDuel Sportsbook reserves the right to cancel any wagers placed on these events given the wager is not possible and no official source for settlement is available
Where the same event is listed more than once on FanDuel Sportsbook, whether with identical or differing odds, such listings shall be considered duplicate events.
FanDuel Sportsbook reserves the right to void any parlay that includes selections from two or more duplicate events, where such selections related to the same underlying event.
Straight bets placed on duplicate events will be settled in accordance with the official result of that event.
The maximum payout for any single bet, or combination of bets relating to the same event or outcome, is $1,000,000 USD, unless otherwise specified.
The maximum payout limit applies to a customer, or a group of customers acting together, regardless of whether bets are placed as a single wager or multiple wagers, at different odds, at different times, or across multiple accounts.
Where total payout from related bets exceeds the maximum limit, FanDuel Sportsbook reserves the right to reduce the total payout to the applicable maximum.
A parlay consists of two or more selections, all of which must win for the overall bet to win.
If one or more selections in a parlay are void then the remaining selections will determine the outcome of the wager, with the odds re-calculated accordingly.
If all selections except one are void, the parlays will be settled as a straight at the applicable odds.
The above also applies to all Same Game Parlay bets.
Parlays containing selections where the outcome of one selection directly affects the outcome or pricing of another selection are not permitted, unless explicitly offered by FanDuel Sportsbook, e.g., as a Same Game Parlay bet
If a parlay containing correlated selections is accepted in error, FanDuel Sportsbook reserves the right to void the affected bet, or settle the affected selections as single bets.
FanDuel Sportsbook reserves the right to refuse or limit and parlay bet at its discretion.
All parlay bets are subject to the rules applicable to each individual selection within the bet.
Round Robin wagers cannot include selections from the same event, if selections from the same event are included in a Round Robin FanDuel Sportsbook reserves the right to settle as if only one selection from the event was included
In the event of a leg in a teaser resulting in a push or void, the following will take place – for two-team teasers the entire teaser is voided, for other teasers the wager is action and will be re-calculated removing the void or push legs.
Cash Out is a feature that allows a customer to settle a bet, in whole or in part, prior to the outcome of the event, at a value determined by FanDuel Sportsbook.
Cash Out is offered at FanDuel Sportsbook’s discretion and is not guaranteed to be available for any bet at any time
Cash Out requests may be subject to a delay before acceptance, during any delay if the Cash Out value changes or the market is suspended, the request will be accepted, and a revised offer may be presented.
If a Cash Out request is accepted, the wager (or relevant portion of the wager) will be settled immediately at the agreed value.
Once accepted, the Cash Out is final, and any subsequent events or outcomes will not be considered.
FanDuel Sportsbook reserves the right to correct or reverse a Cash Out where it has been accepted or settled in error, including due to technical, pricing, or system issues.
Any resettlement may result in adjustments to a customer’s account balance.
FanDuel Sportsbook shall not be liable for any losses arising from the unavailability of the Cash Out feature, or changes in Cash Out values prior to acceptance.
Cash Out may become available for wagers placed with a Bonus Bet once the event is live.
If you do cash out a wager that was placed with a Bonus Bet, you'll only receive the net winnings of the cash out amount. The original Bonus Bet stake is excluded from the cash out value and will not be returned to your account.
Odds Boosts are promotional enhancements applied to selected markets and are subject to these House Rules and any applicable promotional terms.
Unless otherwise specified, all bets placed using an Odds Boost will be settled in accordance with FanDuel’s standard settlement rules.
FanDuel Sportsbook reserves the right to offer, modify, or withdraw any Odds Boost at its discretion.
Where an Odds Boost is intended to apply only to pre-match bets, any bet placed after the event has started may be void if accepted in error.
In the event of a clear and obvious error in the pricing or description of an Odds Boost, FanDuel Sportsbook reserves the right to void the bet, or settle it at the intended price.
For Odds Boosts applied to parlay bets, if any selection within the bet is void, the entire Odds Boost will be void, regardless of the outcome of the remaining selections.
Unless otherwise stated, an Odds Boost applies only to the next scheduled event involving the specified participant(s) or team(s).

First/Next Play Markets
Plays listed as “No Play” on NFL.com do not count for settlement purposes. Wagers on plays as “No Play” will be settled on the next completed play that is not listed as “No Play”.
In the event of penalty yardage being assigned to a play with the play being valid, settlement will be based on the yardage assigned to the individual ball carrier. For instance, if a rushing play for positive yardage is assigned a 10-yard offensive holding penalty that results in the play ending behind the initial yardage before the play, bets will be settled as rushing for 1+ yards.
Sacks are considered a rushing attempt.
Interceptions are considered incomplete passes.
If a team punts or attempts a field goal and the market does not include any special teams play options, all bets will be void.
To Reach X Yard Line

Wagers to reach X Yard Line are inclusive of X Yard. For instance, if the selection is Team A To Reach The 50 Yard Line and they reach exactly the 50 yard line, bets on the Yes will be settled as a winner and bets on the No will be settled as a loser. The team does not need to go 1 yard past this line for the team to have reached the line.
The offense need to make a completed play past the line for the ball to reach the specified line. For instance, if a team throws an interception pass the line, this will not be counted as having reached the line. Also, if a team reaches the specified yard line on the play and loses the ball, market will be settled as if they have reached the specified yard line.
The offensive drive must start behind the specified yard line for bets to be action, for instance if the team returns a punt past the 50 yard line and the drive starts past the 50 yard line, bets on To Reach The 50 Yard Line will be void.

The 8.5 Innings Rule shall automatically apply unless stated otherwise - e.g., in the section below entitled “Overview of Specific Baseball Markets” (which shall take precedence over this section). If a game is shortened due to a rain delay or other deferral, pre-live and live betting markets which have been determined will stand (irrespective of the 8.5 Innings Rule or whether an official league result has been confirmed).
Money Line Bets: Results are official after 5 innings (or 4.5 innings if the home team is leading)
All Other Bets (e.g. Total Runs, Run Line). Results are official only after 9 innings (or 8.5 innings if the home team is leading) unless the outcome has been unequivocally determined.
Batter Markets: (Home Runs, Hits, Runs, RBI’s, Total Bases, Stolen Bases): if the listed player is not included in the starting lineup.Specifically for Plate Appearance related markets offered live, players are not required to have met the aforementioned starting qualifications for these markets to have action (ex. Plate Appearance Result for a Pinch Hitter, etc.).
To Hit a Home Run & Home Run / Game Winner Parlay: Listed players must be included in the starting lineup for bets to stand. Listed pitchers have no bearing on this market.
For bets to have action on any markets relating to Plate Appearances (Batter Up – 1st Pitch Result, Plate Appearance Result, Batter Up, Pitches Per Plate Appearance, Batter Up Plate Appearance 3-Way, Batter Up Exit Velocity), the plate appearance must occur to completion. Plate Appearance related markets for non-starters (i.e. pinch hitters) that are offered will not be subject to the aforementioned “Batter Markets” action requirements (inclusion in the starting lineup). If a player begins a plate appearance but the inning ends before the plate appearance is completed (e.g. via caught stealing or other base-running out), the appearance shall not count for settlement purposes. Any statistics from a plate appearance that did not complete in the previous half inning do not have action, until the plate appearance is completed in the following half inning. If the player does not have another plate appearance in the game, the associated markets will be voided. Pitch-by-Pitch markets do not require plate appearances to be completed for action – once the listed pitch occurs in the listed half-inning, the market will be action.
Result of Plate Appearance: Listed players must record the relevant plate appearance for bets to stand. If listed players do not record a plate appearance, bets on plate appearance markets for that player will be void. If a player is substituted out of the game between plate appearances, bets on plate appearances that have already occurred will stand. However, bets on future plate appearance markets will be voided. For settlement purposes, hit by pitches (HBPs) will be settled as Walk/HBP. A fielder’s choice, catcher’s interference, or reach on error will all be ruled as an “other outcome.” A pitch must be thrown in the plate appearance for bets to be action. If no pitch is thrown in the plate appearance (i.e., the pitching team elects to intentionally walk the batter before any pitches are thrown) bets on the market will be void. This will not impact other markets affected by the result (i.e., the intentional walk results in an RBI for the batter).
Batter Up Markets: Batter Up markets refer to three individual markets offered for each plate appearance (1st Pitch Result, 3-Way Outcome, Total Pitches O/U, and Exit Velocity). Listed players must record the relevant plate appearance for bets to stand. If listed players do not record a plate appearance, bets on that player will be void. If a player is substituted out of the game between plate appearances, bets on plate appearances that have already occurred will stand. However, bets on future plate appearance markets will be voided. A pitch must be thrown in the plate appearance for bets to be action. If no pitch is thrown in the plate appearance (i.e., the pitching team elects to intentionally walk the batter before any pitches are thrown) bets on the Batter Up markets will be void. This shall not however impact other markets which are impacted by the result (i.e., the intentional walk results in an RBI for the batter). For any Batter Up markets to have action, the plate appearance must occur to completion (e.g. if the batter is mid plate appearance and a third out occurs to end the inning, the market will only be settled off the pitches that are thrown in the official plate appearance that occurs to begin the next inning).
Batter Up - 1st Pitch Markets: Settled based on the first pitch thrown to the listed hitter. For settlement purposes, a reach on error, catcher’s interference, or a foul ball that results in an out will be ruled as an “Hit/In Play.” If a pitcher or batter violation results in an automatic ball or strike to begin the at-bat, the market will be settled based off the outcome of the violation (e.g. if a pitcher violation results in an automatic ball to start the at-bat, ‘Ball’ will be settled as the winning selection).
Batter Up Plate Appearance 3-Way: For settlement purposes hit by pitches (HBPs) will be settled as “Any Other Outcome”. A fielder’s choice, catcher’s interference, or reach on error will all be ruled as “Any Other Outcome.”
Batter Up - Pitches Per Plate Appearance: Automatic balls/strikes that result from pitcher/batter violations will count as pitches for settlement purposes. If any pitch or violation occurs in the plate appearance before an intentional walk is signaled, all bets will have action. The same settlement rules will apply to any Alternate Pitches Per Plate Appearance (X+) markets that are offered.
Batter Up – Exit Velocity: Exit Velocity markets will be settled according to official results as published by MLB’s Statcast. The result will only refer to the pitch in which ends the official plate appearance. For settlement purposes, the “Under 94.95 mph” selection includes walks/HBPs, strikeouts, and catcher’s interference. Where MLB Statcast data is unavailable, FanDuel will use a secondary source (i.e. official data feed providers) to confirm exit velocity data.
Pitch-by-Pitch: The pitch must be thrown to the listed batter, during the listed plate appearance, in the listed half-inning, for bets to have action. If no pitch is thrown (i.e. the pitching team elects to intentionally walk the batter before any pitches are thrown), bets on Pitch-by-Pitch markets for that plate appearance will be void. Pitcher and batter violations will count towards settlement of this market. For settlement purposes, the “Hit/In Play” selection includes any hits, battled balls put in the field of play, catcher’s interference, and batted balls that result in an out(s) being recorded (including outs caught in foul territory). In the event that a plate appearance does not occur to completion (e.g. if the batter is mid plate appearance and a third out occurs to end the inning), pitch-by-pitch markets that were offered and have been decided in the listed half-inning will be action, while those that did not occur will be void.
To Hit First Home Run: Listed players must be included in the starting lineup for bets to stand. If listed players are not included in the starting lineup, bets on that player will be void. If a non-listed player is ruled the winner, bets on listed qualified players are action. If no Home Runs are hit in the game, “No Home Run” will be deemed the winning selection.
To Hit Next Home Run: Listed players must record at least one plate appearance for bets to stand. If listed players do not record a plate appearance, bets on that player will be void. Once a player has recorded a plate appearance, wagers made on that player for all subsequent indices (Player to Hit 3rd Home Run, 4th Home Run, etc.) will stand regardless of the number of plate appearances that player ultimately records in the game. If no “Next Home Run” is hit, “No Xth Home Run” will be deemed the winning selection.
Player to Record a Hit Markets: Listed players must be included in the starting lineup for bets to stand. Once a player has recorded a plate appearance, bets on all subsequent hits markets (2+ hits, 3+ hits, etc.) will stand regardless of the number of plate appearances that player ultimately records in the game.
To Record Total Bases: Total Bases are recorded through hits. They do not include walks, HBPs, reach on errors, or fielder's choices.
Player Total Strikeouts: Listed Pitcher must start for bets to stand. If the opposing Listed Pitcher does not start, then bets will still stand.
Player Combo Markets: All listed players must be included in the starting lineup for bets to stand, unless the market is unequivocally determined by the performance of the other listed players.
Player Performance Parlays: For pitchers, the listed pitcher must start for bets to stand. Bets will stand regardless of a change in status to the opposing listed pitcher. For batters, the listed player must be included in the starting lineup for bets to stand. If listed players are not included in the starting lineup, bets on that player will be void. A change to the status of either listed pitcher will have no bearing on the settlement of any batter-specific player parlay.
Result of First Half-Inning Pitch: Settled based on the first pitch thrown in the listed half inning. A change to the status of either listed pitcher, or to either line-up, will have no bearing on the settlement of this market. For settlement purposes, a reach on error, catcher’s interference, or a foul ball that results in an out will be ruled as an “other outcome.” Batted balls that result in the plate appearance ending (ex. hits/outs) will not be regarded as strikes for the purposes of settlement. If a pitcher or batter violation results in an automatic ball or strike to begin the at-bat, the market will be settled based off the outcome of the violation (e.g. if a pitcher violation results in an automatic ball to start the at-bat, ‘Ball’ will be settled as the winning selection).
Method of First Hit: Settled based on the method by which the first hit of the game (for either team) occurs. A change to the status of either listed pitcher will have no bearing on the settlement of this market. If no hits are recorded in the game, “No Hit” will be deemed the winning selection.
Method of First RBI: Settled upon the method by which the first RBI of the game (for either team) occurs. A change to the status of either listed pitcher will have no bearing on the settlement of this market. All RBI’s not recorded from a base hit will be categorized under the “Other” selection. If no RBI’s are recorded in the game “No RBI” will be deemed the winning selection.
Player to Record First Hit: Listed players must be included in the starting lineup for bets to stand. If listed players are not included in the starting lineup, bets on that player will be void. If a non-listed player is ruled the winner, bets on listed qualified players are action. If no hits are recorded in the game, “No First Hit” will be deemed the winning selection.

Player to Hit First Home Run of Day: If listed player is in the starting lineup bets are action. Any non-starters will be voided. Settlement will be determined on the time of day in which the first home run is hit, rather than the elapsed time/inning within an individual game.

If listed players do not record a plate appearance, bets on that player will be void. If no pitch is thrown in the batter's first plate appearance (i.e., the pitching team elects to intentionally walk the batter before any pitches are thrown) bets on the market will be void.
For a player prop that specifies an inning range within the game, players must record a plate appearance in that listed range for action. For example, a player must record a plate appearance in the first 5 innings for action on a "Player to Hit a Home Run in the First 5 Innings" market.

Should a batter or pitcher violation occur before a pitch is thrown in the plate appearance, wagers will be settled based on the first pitch thrown following the violation. For relief pitcher velocity markets, the listed batter vs. pitcher matchup must occur in the listed inning for wagers to have action.

For compliance reasons and identity verification obligations, provision of this information, when requested, may be a mandatory condition of using some or all of the Services. We may collect this information through various forms and in various places on the Services, including if you register for an account, through “contact us” forms, or when you otherwise interact with the Services. If you contact us, by email, text message, phone call, or otherwise, in addition to any Personal Information we may receive, we may record and store the contents of those communications ourselves or using a third-party vendor. We may use the contents of these communications for training or other purposes and to satisfy our legal, auditing, and other obligations, or for any reason set forth in this Privacy Policy. Your communications with us might include requests, questions, and/or issues regarding your use of the Services or other topics you might raise. If we combine Demographic Information with the Personal Information we collect directly from you on the Services, we will treat the combined data as Personal Information under this Privacy Policy.
In addition to any Personal Information or other information that you choose to submit to us via our Services, we and our third-party service providers may use a variety of technologies that automatically (or passively) store or collect certain information whenever you visit or interact with the Services (“Usage Information”). This Usage Information may be stored or accessed using a variety of technologies that may be downloaded to your personal computer, browser, laptop, tablet, mobile phone or other device (a “Device”) whenever you visit or interact with our Services. When your Device contacts our web servers (for example, when you visit this Services or view an HTML e-mail), our web servers automatically collect Usage Information. We also may determine the applicable technology available in order to serve you the most appropriate version of a web page, e-mail, advertising or promotional announcement or similar service. To the extent we associate Usage Information with your Personal Information we collect directly from you on the Services, we will treat it as Personal Information.
This Usage Information may include:
We may use Tracking Technologies for a variety of purposes, including:
You will not be able to use wagering services or place bets with us without location data being turned on. Our Services use precise location-based services (e.g., location collected through GPS technology), in order to locate you so we may verify your location, process payments, perform analytics, deliver you relevant content and ads based on your location, share your location with our vendors as part of the location-based services we offer, and for purposes of legal and regulatory compliance. We also collect non-precise geolocation data (i.e., the city and state in which your device is located based on its IP address). This non-precise geolocation data allows us to customize your experience, give you access to content that varies based on your general location, and serve you ads that are relevant to you. For instance, if your IP address is associated with Baltimore, Maryland, we are able to direct you to the services, landing pages, and offers specific to individuals located in Maryland. Both precise and non-precise geolocation may be disclosed to third party entities pursuant to Section 3(c) below.
We may receive information about you from your friends and others that use the Services. Additionally, we may, from time to time, supplement the information we collect directly from you on our Services with outside records from third parties for various purposes, including to enhance our ability to serve you, to tailor our content to you and to offer you opportunities that may be of interest to you. You authorize your wireless carrier to use or disclose information about your account and your wireless device, if available, to us or our service provider for the duration of your business relationship, solely to help us identify you or your wireless device and to prevent fraud. To the extent we combine information we receive from third-party sources with Personal Information we collect on the Services, it will be treated as Personal Information and we will apply this Privacy Policy to such combined information, unless we have disclosed otherwise. In no other circumstances do our statements under this Privacy Policy apply to information we receive about you from third parties, even if they have used our technology to collect it and share it with us.
The Service may include functionality that allows certain kinds of interactions between the Services and a third-party website or application. The use of this functionality may involve the third-party operator providing certain information, including Personal Information, to us. For example, we may provide third-party sites’ interfaces or links on the Services to facilitate your sending a communication from the Services such as facilitating emails, tweets or Facebook postings. These third parties may share information with us and they may also retain any information used or provided in any such communications or other activities and these third parties’ practices are not subject to our Privacy Policy. We may not control or have access to your communications through these third parties. Further, when you use third-party sites or services, you are using their services and not our services and they, not we, are responsible for their practices. You should review the applicable third-party privacy policies before using such third-party tools on our Services.
You may send someone else a communication from the Services, such as sending an invitation to a friend. If so, the information you provide (names, email addresses, etc.) is used to facilitate the communication and is not used by us for any other marketing purpose unless we obtain consent from that person or we explicitly say otherwise. Please be aware that when you use any send-to-a-friend functionality on our Services, your contact information, name or username and message may be included in the communication sent to your addressee(s). Some of these tools may be third-party tools subject to third-party privacy policies.
Various third parties are developing or have developed signals or other mechanisms for the expression of consumer choice regarding the collection of information about an individual consumer’s online activities over time and across third-party websites or online services (e.g., browser do not track signals). Currently, we do not monitor or take any action with respect to these signals or other mechanisms.
We may use your Personal Information, Demographic Information or Usage Information that is subject to this Privacy Policy:
We may share non-Personal Information, including Usage Information, such as aggregated user statistics, with third parties. Further, we may share your Device Identifiers with third parties along with data related to you and your activities. Also, we may share your Personal Information with third parties with whom we have marketing or other relationships for the third parties’ direct marketing purposes. Additionally, in our continuous effort to provide services that we believe you may find useful or of value, we may make your Personal Information available to third parties to better facilitate your requests, provide more personalized services and communicate separately with you. If we use a vendor to facilitate or assist in communication with you, the vendor will receive your Personal Information (such as your name, email, or telephone number) and may record and store the content of your communications with us; however, we do not disclose mobile phone numbers to unaffiliated third parties for their marketing purposes without your consent. We may also share the information we have collected about you, including Personal Information, as disclosed at the time you provide your information and as described below or otherwise in this Privacy Policy. BIU may additionally disclose your information under the following circumstances and conditions:
You may be presented with an option on our Services to receive certain information and/or marketing offers directly from third parties or to have us send certain information to third parties or give them access to it. If you choose to do so, your Personal Information and other information may be disclosed to such third parties and all information you disclose will be subject to the third-party privacy policies and practices of such third parties. In addition, third parties may store, collect or otherwise have access to your information when you interact with their Tracking Technologies, content, tools, apps or ads on our Service or link to them from our Service. This may include using third-party tools such as Facebook, Twitter, Pinterest or other third-party posting or content sharing tools and by so interacting you consent to such third party practices. We are not responsible for the privacy policies and practices of such third parties and, therefore, you should review such third-party privacy policies and practices of such third parties prior to requesting information from or otherwise interacting with them.
We may use third-party vendors to perform certain services on behalf of us or the Services, such as: (i) to assist us in Services operations; (ii) to facilitate communications with you and/or provide customer support; (iii) to manage a database of customer information; (iv) to host the Services; (v) to design and/or operate the Services’ features; (vi) to track the Services’ activities and analytics; (vii) to enable us to send you special offers or perform other administrative services; (viii) to process payments and deliver prizes; and (ix) other services designed to assist us in maximizing our business potential. For example, from time to time, we will use the information we collect to coordinate data entry and payments with the company that provides you with handicapping information, to coordinate marketing/rewards programs with partner racetracks, and to offer other enhancements to the Services. We may provide these vendors with access to user information, including Device Identifiers and Personal Information, to carry out the services they are performing for you or for us. For instance, our SMS messaging services are powered by Zoom. To provide us with such service, Zoom will receive your phone number and may receive and maintain copies of your SMS or text communications with us. Third-party analytics and other service providers may set and access their own Tracking Technologies on your Device and they may otherwise collect or have access to information about you, potentially including Personal Information, about you. We are not responsible for those third party technologies or activities arising out of them. However, some may offer you certain choices regarding their practices, and information we have been informed of regarding such choices is available here. We are not responsible for the effectiveness of or compliance with any third parties’ opt-out options.
We may access, use, preserve, transfer and disclose any of your information (including the content of your communications with us, Device Identifiers and Personal Information, including precise geolocation data and other potentially sensitive Personal Information) to third parties: (i) to satisfy any applicable law, regulation, subpoenas, governmental requests or legal process if in our good faith opinion such is required or permitted by law; (ii) to protect and/or defend the Services’, its integrity, and our Terms and Conditions or other policies applicable to the Services, including investigation, determination, or validation of potential violations thereof; (iii) to protect the safety, rights, property, integrity, or security of the Services or any third party; and/or (iv) to detect, prevent or otherwise address fraud, security or technical issues. Such potential disclosures include disclosing Personal Information and Device Identifiers to gaming regulators, leagues, associations, governing bodies, sports teams, colleges or oversight agencies or boards (or their designated vendors) in relation to the enforcement of our Terms and Conditions and their rules governing authorized betting, including in connection with identifying or overseeing their athletes, employees, personnel, or members. We may also use IP address or other Device Identifiers to identify individuals, either acting alone or in cooperation with third parties such as copyright owners, internet service providers, wireless service providers and/or law enforcement agencies. Such identifying information may be disclosed pursuant to this Section.
Such disclosures may be carried out without notice to you. In circumstances where we inadvertently obtain information that appears to pertain to the commission of a crime or where we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person exists, BIU may voluntarily disclose the record or the contents of your communications or other information about you to law enforcement agencies and governmental entities without providing you advance notice. Upon receipt of an applicable search warrant or administrative, grand jury or trial subpoena, BIU may be required to disclose to the government or law enforcement agencies, without advance notice to you, the content of your communications and other records relating to your electronic communications, as well as the following records: your name and address; records of your online communication (including session times and duration); how long you have subscribed to our service(s) (including start date) and the type(s) of service(s) utilized; your telephone number or other subscriber account identifying number(s), including any Internet or network address(es) assigned to you by our network; and the means and source of your payment(s) (including any debit card or bank account number).
We may share your information, including your Device Identifiers and Personal Information, Demographic Information and Usage Information with our parent, subsidiaries and affiliates, including for their marketing or other purposes. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner or operator of the Services or applicable database; or (ii) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets or other corporate change, including, during the course of any due diligence process.
The Services may permit you to submit ideas, photographs, video, audio recordings, computer graphics, pictures, data, information about your location, questions, comments, suggestions or other content, including Personal Information (collectively, “User Content”). We or others may store, display, reproduce, publish, distribute or otherwise use User Content online or offline in any media or format (currently existing or hereafter developed) and may or may not attribute it to you. Others may have access to this User Content and may have the ability to share it with third parties. Please think carefully before deciding what information you share, including Personal Information, in connection with your User Content. Please note that BIU does not control who will have access to the information that you choose to make public, and cannot ensure that parties who have access to such publicly available information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information that you make publicly available on the Services or what others do with information you share with them on the Services. We are not responsible for the accuracy, use or misuse of any User Content that you disclose or receive from third parties through the Services.
We may also publish your name, voice, likeness and other Personal Information that is part of your User Content, and we may use the content, or any portion of the content, for advertising, marketing, publicity and promotional activities. For full terms and conditions regarding User Content you submit to the Services, please review our Services’ Terms and Conditions.
We and third parties such as network advertisers and ad exchanges may serve advertisements on the Services or across the Internet and may use third party analytics service providers to evaluate and provide us and/or third parties with information about the use of these ads on third party sites and viewing of ads and of our content. Network advertisers are third parties that display advertisements, which may be based on your activities across the Internet and mobile media (“Behavioral Ads”). Behavioral Ads enable us to target advertisements to you for products and services in which we believe you might be interested. If you object to receiving Behavioral Ads from us on third party sites, you can learn more about your ability to limit Behavioral Ads below.
Our third party ad network and exchange providers, the advertisers and/or traffic measurement services may themselves set and access their own Tracking Technologies on your Device and track certain behavioral Usage Information via a Device Identifier. These third party Tracking Technologies may be set to, among other things: (a) help deliver advertisements to you that you might be interested in; (b) prevent you from seeing the same advertisements; and (c) understand the usefulness of the advertisements that have been delivered to you. You acknowledge and agree that associated technology may access and use your Device and may set or change settings on your Device in connection with the associated operations. Note that any images (or any other parts of content) served by third parties in association with third-party ads or other content may serve as web beacons, which enable third parties to carry out the previously described activities.
Third-party Tracking Technologies are not controlled by us, even if they use our technology to help store or collect data. Statements regarding our practices do not apply to the methods for collecting information used by these third parties or the use of the information that such third parties collect. We do however work with third parties to make efforts to have you provided with information on their practices and any available opportunity to exercise choice. The relevant third party’s terms of service, privacy policy, permissions, notices and choices should be reviewed regarding their collection, storage and sharing practices. We make no representations regarding the policies or practices of third party advertisers or advertising networks or exchanges or related third parties.
We may use third-party advertising companies to target advertisements to you on our Services, across the web, on your mobile Device and on any of your other Devices, based on the information we have collected from and about you, as well as information relating to your and other users’ visits to this and other websites and online services. To do so, these companies may place or recognize a unique cookie on your browser (including through the use of pixel tags) or recognize an identifier associated with your mobile device. These companies may also use these Tracking Technologies, along with personal information they or we collect on the different devices you use, to recognize you across the Devices you use, such as a mobile device and a laptop or other computer. Some third parties may offer you certain choices regarding their practices, and information we have been informed of regarding such choices is available here.
Further, while sites use a variety of companies to serve advertisements, you may wish to visit https://thenai.org/opt-out/, which provides information regarding this practice by Network Advertising Initiative (“NAI”) members, and your choices regarding having this information used by these companies, including the “opt-out” procedures of NAI members, including through the Network Advertising Initiative's Consumer Opt-Out link. Opting out of one or more NAI members only means that those NAI members no longer will be allowed under their own rules to deliver Behavioral Ads to you, but does not mean you will no longer receive any targeted content and/or ads. Also, if your browsers are configured to reject cookies when you visit this opt-out page, or you subsequently erase your cookies, use a different Device or change web browsers, your NAI opt-out may not, or may no longer, be effective.
You may also opt-out of receiving Behavioral Ads on participating sites and services by visiting the Digital Advertising Alliance (“DAA”) website at http://www.aboutads.info/choices. To opt out of Google Analytics display advertising or customize Google display networking ads, visit the Google Ads Setting page. For Mobile applications, you can use the "DAA App Opt-Out Tool" and the NAI App Opt-Out Tool". Similar limitations may apply to the DAA opt-out. We are not responsible for effectiveness of or compliance with any third parties’ opt-out options or programs.
Please note that these opt-outs apply per browser and per device, so you will have to opt out for each device — and each browser on each device — through which you access our Services.
When you are on the Services you may be directed to other sites and apps that are operated and controlled by third parties that we do not control such as merchants who directly sell products and services to you. We are not responsible for the data collection and privacy practices employed by any of these third parties or their sites or apps and they may be tracking you across multiple online services and may be sharing the results of that tracking with us and/or others. These third parties may have their own terms of service, privacy policies or other policies and ask you to agree to the same. For example, if you “click” on a link, the “click” may take you off the Services onto a different location. These other online services may associate their Tracking Technologies with you, independently collect information about you, including Personal Information, and may or may not have their own published privacy policies. We are not responsible for these third-party privacy policies or the practices of third-party owners. Be sure to review any available policies before submitting any personally identifiable information to a third-party online service or otherwise interacting with it and exercise caution in connection with these services. We also encourage you to note when you leave our Services and to review the third-party privacy policies of all third-party locations and exercise caution in connection with them.

The Services may allow you to review, correct or update Personal Information you have provided through the Services’ registration forms or otherwise by updating your account, and you may provide registration updates and changes by contacting us by email at: support@fanduel.com. If so, we will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable (but we may retain prior information as business records). Please note that it is not always possible to completely remove or delete all of your information from our databases and that residual data may remain on backup media or for other reasons. When you edit your Personal Information or change your preferences on the Services, information that you remove may persist internally for BIU’s administrative purposes. You may cancel or modify the email marketing communications you receive from us by following the instructions contained within our promotional emails. This will not affect subsequent subscriptions and if your opt-out is limited to certain types of emails the opt-out will be so limited. Please note that we reserve the right to send you certain communications relating to your account or use of our Services, such as administrative and Service announcements, and the SMS Service Alerts set out in our Terms and Conditions. These transactional account messages may be unaffected if you choose to opt-out from receiving our marketing communications.
